Corporate Manslaughter Date: 3rd November 2003 Subject Heading: Health, Economics Crimes (Corporate Manslaughter) Amendment bill Every 2 days somebody is killed in the workplace in NSW. In 2002 178 people died in NSW from Workplace related disease and injury. This is more than those innocent people who died after the Bali bombing, the Port Arthur massacre and the Thredbo Landslide combined. Of these fatalities, 68 occurred in the workplace. This bill proposes to amend the NSW Crimes Act 1900 to create the offence of corporate manslaughter for which a corporation may be held liable for a maximum penalty of $5 million fine. The bill also creates a further offence in respect of a senior officer who participates in corporation's commission of the offence of corporate manslaughter where the maximum penalty is 5 years imprisonment or a fine of $180,000 or both.
